Terms of Service

These Terms of Service ("Terms") govern your use of the Watch My Calories mobile application ("the App") and its associated services, operated by Carra Labs ("we", "us", "our").

By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Description of Service

Watch My Calories is a calorie and nutrition tracking application that helps users log meals, track nutritional intake, and receive AI-powered food recognition and nutrition analysis. The App offers both free and premium (paid subscription) features.

2. Account Registration

• You must sign in using a valid Google account.
• You must be at least 16 years old to use the App.
• You are responsible for maintaining the security of your account and for all activity that occurs under your account.
• You agree to provide accurate and complete information during registration and to keep your profile information up to date.

3. Free and Premium Features

3.1 Free Features

The following features are available at no cost:

• Manual meal and food entry logging
• Food search (USDA database and Open Food Facts barcode scanning)
• Custom food catalog entries
• Daily and weekly nutrition tracking and progress dashboard
• Nutrition goal setup (manual calculation)
• Data synchronization across devices
• Custom meal types

3.2 Premium Features (Subscription Required)

The following features require an active Premium subscription:

• AI-powered food recognition from photos
• AI nutrition advice and daily intake analysis
• AI-generated meal plans and food suggestions
• AI-assisted nutrition goal generation

3.3 Subscriptions

• Premium subscriptions are billed through Google Play.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your Google Play account settings.
• Refunds are handled in accordance with Google Play's refund policies.

• AI features use Google's Gemini technology to analyze food photos and provide nutrition information.
• AI results are estimates — they may be inaccurate, incomplete, or incorrect. Always verify important nutritional information independently.
• AI features require an internet connection and are subject to availability.
• Premium users are subject to reasonable daily usage limits to prevent abuse.
• By using AI features, you consent to the processing of relevant data (photos, nutrition data, profile information) by AI services as described in our Privacy Policy.

6. User Content & Data

• You retain ownership of all content you create in the App (food entries, recipes, meal plans, photos).
• You grant us a limited license to process your content solely for the purpose of providing the App's services to you.
• You are responsible for the accuracy of the information you enter.
• Food photos are stored on your device only and are not permanently stored on our servers.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to our servers or other users' accounts.
• Use automated scripts, bots, or other means to excessively access AI features.
• Reverse engineer, decompile, or disassemble the App.
• Share or resell your Premium subscription access.

8. Intellectual Property

The App, including its design, code, content, and branding, is the property of Carra Labs and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our prior written consent.

9. Availability & Modifications

• We strive to keep the App available at all times but do not guarantee uninterrupted service.
• We may modify, suspend, or discontinue features at any time. For material changes to paid features, we will provide reasonable notice.
• We may update these Terms from time to time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind.
• We do not warrant the accuracy, completeness, or reliability of any nutritional information, whether entered manually or generated by AI.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claims arising from the App shall not exceed the amount you paid for Premium subscription in the 12 months preceding the claim.

11. Account Termination

• You may delete your account at any time through the App's settings or by contacting us.
• We may suspend or terminate your account if you violate these Terms.
• Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Spain.
